Phoji L.L.C., a Minnesota limited liability company provides this Privacy Policy to help you make an informed decision about whether to use or continue using phojiapp.com and the Phoji software (collectively, “Phoji”). If you do not agree to the terms contained in Phoji’s Privacy Policy, do not use Phoji. This Privacy Policy is incorporated into and is subject to the Phoji Terms of Service. Your use of Phoji and any Personally Identifiable Information you provide on the Phoji site is subject to the terms of this Privacy Policy and Phoji’s Terms of Service. This Privacy Policy explains how we collect and use the information you provide when you use Phoji. This Privacy Policy does not apply to the practices of companies that Phoji does not own or control, or to individuals whom Phoji does not employ or manage.

Personally and Non-Personally Identifiable Information:

When using Phoji, you may be asked to provide, or you may choose to submit, certain personally identifiable information about yourself (“Personally Identifiable Information”), such as your name, email address, telephone number, location or other information you may provide. In addition, we may also collect non-personally identifiable information, such as device type, duration and frequency of visits, and other data, and may aggregate any information collected in a manner which does not identify any individual. The contents of messages that have been delivered by Phoji are kept by Phoji in the normal course of business.

We may disclose or otherwise make available Personally Identifiable Information about you to third party service providers that assist us in the design, development and/or operation of Phoji. We may also work with analytic companies to help us understand how Phoji is being used, such as the frequency and duration of usage. These providers may collect device-specific information when you use Phoji.

You can stop all collection of information by Phoji by uninstalling Phoji.

Information Usage:

We may use the Personally Identifiable Information we collect to contact you about our services or those of our partners or other third parties from time to time. We will not sell your Personally Identifiable Information to third parties or mass marketers.

Please note that Phoji reserves the right to and may disclose Personally Identifiable Information about you in response to (a) requests from local, state or federal law enforcement officials; (b) any judicial, administrative or similar proceeding or order, such as a subpoena; (c) if required by law; or (d) to investigate suspected fraud, harassment, physical threats, or other violations of any law, rule or regulation, Phoji’s rules or policies, or the rights of third parties or to investigate any suspected conduct which we deem improper.

Please also note that we reserve the right to transfer your Personally Identifiable Information and other information to our successors in business and purchasers of Phoji stock or assets. In the event of Phoji’s bankruptcy, insolvency, reorganization, or assignment for the benefit of creditors, Phoji may not be able to control how your Personally Identifiable Information and other information is treated, transferred or used.

Children’s Privacy:

Phoji does not knowingly collect or maintain Personally Identifiable Information from persons under 13 years of age. Phoji encourages parents and guardians to spend time with their children online and to be familiar with the online services used by their children. If a parent or guardian becomes aware that a child under the age of 13 has provided Phoji with Personally Identifiable Information without their consent, he or she should contact us at support@phojiapp.com, and Phoji will delete such information from its files within a reasonable time.

Cookies:

When you visit Phoji, we may send a “cookie” (a string of information that is sent by a web site to be resident on your system’s hard drive, and/or temporarily in your computer’s memory blocks). The purpose of a cookie is to tell the web server that you have returned to a particular page, to retain login information or to otherwise remember preferences and enhance your experience on Phoji. We may allow third parties to set cookies through Phoji in order to help us manage and analyze the performance of the Phoji site. You may set your browser to decline cookies. If you do so, however, you may not be able to fully experience some features of Phoji.

Do Not Track Requests:

At this time our website does not alter its behavior or change its services upon receiving Do Not Track browser signal requests.

Security:

Phoji will not be liable for disclosures of your Personally Identifiable Information due to errors in transmission or unauthorized acts of third parties. We have undertaken commercially reasonable efforts to prevent unauthorized Internet access to visitor data retained in our servers, however, due to the inherent open nature of the Internet, Phoji cannot ensure or warrant the security of any information you transmit to us or any information provided online, and you do so at your own risk. Users must accept all risks associated with any data transmission, including the risk that their Personally Identifiable Information may be intercepted in transit.

Social Networking and Public Forums:

You should be aware that Personally Identifiable Information which you voluntarily include and transmit online may be viewed collected and used by us and by others, and could be used to personalize your experience. Users of Phoji are solely responsible for the content of messages they post online including on public forums. These forums include but are not limited to social networking services or publicly accessible forums which may be viewed and used by anyone with access to such forums. Users should be aware that when they voluntarily disclose Personally Identifiable Information within a public forum that user information may be collected and used by others. By using such services you assume the risk that the Personally Identifiable Information provided by you may be viewed, collected and used by third parties.

Opt-Out:

Upon installing Phoji, you will automatically be following the Phoji Broadcast. We give you the choice to opt-out of following Phoji at any time.

We also give you the choice to opt-out of receiving marketing email communications from Phoji. To opt-out of our marketing email a link will be provided in the email that you will click and confirm the opt-out.

We are not responsible for removing your Personally Identifiable Information from the lists of any third party who has previously been provided your information in accordance with this Privacy Policy.

Modifications:

We reserve the right, at our discretion, to change, modify, add, or remove portions of this Privacy Policy at any time. However, if at any time in the future we plan to use Personally Identifiable Information in a way that differs from this Policy, we will post such changes here. Your continued use of Phoji following the posting of any changes to this Policy means you accept such changes. Please check this page periodically for changes to this Privacy Policy

Communications with Phoji:

Any communication or material you transmit to us by email or otherwise, including any data, questions, comments, suggestions, or the like is, and will be treated as, non-confidential and non-proprietary. Except to the extent expressly covered by this Privacy Policy, anything you transmit or post may be used by us for any purpose, including but not limited to, reproduction, disclosure, transmission, publication, broadcast and posting. Furthermore, you expressly agree that we are free to use any ideas, concepts, know-how, or techniques contained in any communication you send to us without compensation and for any purpose whatsoever, including but not limited to, developing, manufacturing and marketing products and services using such information.
